Call for Researchers: US Court Cases

The Foundation is currently seeking a researcher to work with us on a freelance basis. This research focuses on case summaries of recent, important, and relevant information governance/records and information management orders and opinions issued by the courts in the U.S. It is intended to close the gap for the period following the publication of Skupsky and Montana’s seminal work: Law, Records and Information Management: The Court Cases (Information Requirements Clearing house, 1994).

Law, Records, and Information Management: The Court Cases by Skupsky and Montana covers court cases up to approximately 1994 with one additional supplement. There is no recent, single source for relevant information management-related court cases, so there is a gap for single source coverage of these type of court cases.

Court cases are considered when developing policies and procedures for an information management program, as it provides insight into how the courts interpreted given laws. A compilation of information management-related court cases is important to information management professionals and others to provide insight into how the courts interpreted specific information management-related laws. Regulations and other legal considerations inform important policies such as a company’s retention schedule, destruction policies, etc. by stating what must be done. On the other hand, court cases inform practice on how it should be done.

The methodology includes legal research and reviews of court cases in the form of books and guides available through libraries and websites, and legal reviews of laws and standards, also available online.

The report will be reviewed prior to publication. A Foundation liaison will be assigned to the project and work with the lead researcher through its duration.

Available Funding: $5,000.00 in installments per contract.

Contract Term: Eight months from the date of signed contract.
